From The dress of the person in the video it looks like it was produced in the late 90's and that is EXACTLY where the State wants the education level of average person about firearms to stay. I almost broke out in hives when I saw a LEO's talk with common sense, straight forward and truthful. I honestly cant recall the last time prior to today. Great Vid. T |

Machine guns and silencers are perfectly legal in Florida but you have to jump through legal hoops ,pay for the tax stamp , and you are going to pay thousands for a gun worth hundreds. I don't really see much advantage to owning a full auto . Now silencers are a different story altogether .

Most people are not aware that an average citizen can own a machine gun or a suppressor (silencer) by completing the appropriate paperwork and paying the corresponding fees. Here is a summary of the basic requirements for NFA (National Firearms Act Class 3) ownership:
bullet You have to live in a state that allows its citizens to own the type of firearm that you want to purchase. For instance, some states do not allow any NFA firearms, others allow machine guns but not suppressors while most others allow all NFA. To the best of our knowledge as of this writing: bullet Machineguns are LEGAL for individuals to possess in all states EXCEPT in DE, DC, HI, NY, WA. bullet Suppressors (silencers) are legal in all states EXCEPT in DE, DC, HI, IL, MT, NY, NJ, RI. bullet You have to meet the federal requirements of the 4473 "Yellow Form", such as 21 or older, clean criminal background, no dishonorable discharge, US citizen, etc. Basically if you can legally purchase a handgun, you can legally purchase an NFA (Class 3) firearm. bullet There is no license required to own an NFA (Class 3) firearm. There is a one time tax that must be paid to ATF when you apply to have the registration transferred to your name. There is no ongoing yearly fees charged by the ATF. For machine guns, suppressors, short barrel shotguns, short barrel rifles and destructive devices, there is a one time $200 tax in addition to the purchase price of the firearm. For an AOW (Any Other Weapon) firearm, there is a $5 transfer tax. Even if you purchase 10 machine guns and 10 suppressors, EACH one would have a $200 tax. ATF will issue a tax stamp for $200 upon your approval and that tax stamp along with the form that it is affixed to is your receipt and proof of legal ownership. bullet The sheriff or chief of police or state police, whichever is YOUR Chief Law Enforcement Officer must be willing to sign your Form 4 (Application for Tax Paid Transfer and Registration of an NFA Firearm) attesting that he does not know of any reason that you should not have the NFA firearm. Whether you have a concealed carry permit, have a perfectly clean criminal background, voted for him or whatever, it is at the discretion of the CLEO (Chief Law Enforcement Officer) whether or not he will sign. He has no legal obligation to sign and if he will not sign, ATF will not process your application for Tax Paid Transfer and Registration of an NFA Firearm, and you will not get the firearm. If you own a corporation, you can transfer the NFA firearm to the corporation and no CLEO signature is necessary. bullet You have to be fingerprinted by the CLEO and the print cards are submitted to ATF along with your $200 tax and your completed Form 4 (Application for Tax Paid Transfer and Registration of an NFA Firearm). bullet You have to have the serial number before any paperwork can be printed or processed to begin the transfer to you which means that you have to pay for your firearm in order to start paperwork unless other arrangements are made between you and your instate dealer. bullet It takes about 90 days for ATF to approve the transfer of your NFA firearm to you. During that time, your local dealer who provided you with the Form 4 application, will maintain possession and ownership. After ATF approves the transfer and returns the approved Form 4 to your local dealer, then you can take possession of the firearm. bullet Some states (such as LA, MD etc) have additional state transfer and licensing requirements. Some states will only allow its citizens to purchase C & R (Curio and Relic) firearms which are designated by ATF to be C & R status. Generally only original (not USA made remanufactured firearms such as MACs) firearms qualify as C & R and as such they command a premium price. |

The last time I checked it out NFA Weapons Machine guns, Suppressors Short Barreled Rifles, Short Barreled shotguns, Etc were legal in 35 out of the 50 (57 If your Obama) US States. There is a load of paper work one has to go through and a lot of regulations. Here is a link for you to read and understand. I was a 01 FFL and a 03 SOT when I lived in Reno NV 10 years ago. TA, Where you been hiding? You didn't know about class 3 weapons. Heck I live in the mid-atlantic and I can go start the paperwork anytime I want. I just do not want to have one in my possession. A friend has a couple of drop in auto-sear's that can go in and out of multiple HK's. The sear's are the regitered class three component.
You have to get fingerprinted, pay the $200 tax stamp, and they have to be manufactured before a certain date, but you can get them. Get out of NJ! I have never done a classs 3 purchase or even an SBR. I don't want to be in that ATF database. I have heard (not sure if it is true) that the ATF can request you produce the gun at anytime to prove you still have possesion of it. "THE REGISTERED & TRANSFERABLE DROP-IN AUTO SEAR This is a an auto sear made before 1986 and registered (tax paid) with the BATF as a machinegun. Currently (Nov-2003) they sell in the $7500 - 8500 price range and require an additional $200 transfer tax to own. This is the only type an individual can use to make an AR15 full auto. To obtain one, an individual (non FFL/SOT) would have to live in a state that permits ownership of full auto firearms and complete a BATF form 4 in duplicate with fingerprints, pictures, and a CLEO certification. The auto sear itself is legally the same as a complete transferable machinegun - it is legal to own and use, provided the paperwork is filed with BATF and you receive an approved form 4. The registered auto sear requires installation of M16 (full auto) fire control parts (trigger, disconnector, selector, hammer, and bolt carrier) in the semi automatic host rifle. Normally, even possession of an M16 part with an AR15 is a felony - it doesn’t even have to be installed in the gun! If you own a registered DIAS however, possession is permitted as long as you are the legal owner of a registered DIAS. If the DIAS is removed from the rifle, the M16 parts MUST BE REMOVED also. The instant a registered DIAS is removed, any M16 parts in the AR15 will constitute a felony. The same principle also applies to barrel length. If you have a short barrel (less than 16”) on an AR15 with a registered DIAS installed, you must remove the barrel/upper whenever the DIAS is not in the gun. The registered DIAS can be installed in either a pre or post ban AR15 with all the evil assault features you wish. Because the DIAS makes the rifle full automatic when installed, it is no longer covered by the 1994 assault weapons ban, which defines an assault weapon as a “semiautomatic rifle” with specific features (bayo. lug, threaded barrel, flash hider, etc.). When the sear is removed from a post-ban gun, you must restore the gun to a post-ban configuration, and remove those evil assault features. Just remember, when the registered DIAS is installed, the host gun becomes like a machinegun and is treated as such. The instant the DIAS is removed, the host firearm must revert back to its original semiautomatic state (no F/A parts, no short barrels), and if a post ban, it must comply with the assault weapons ban." http://www.quarterbore.com/nfa/dias.html |

Indiana also allows Class 3 weapon/component ownership. Full automatics, silencers, hell the gun dealer I goto has a silencer for an AR-15, but it's 900 bucks. That's not including the tax stamp and BATF paperwork.
